A power of attorney, conservator or guardianship may never be needed, but it’s better to proactively consider the pros and cons of available options and consult a lawyer as needed before financial access is delegated.
Conservator and guardian
A conservator or guardian is appointed by a judge to protect and manage the financial affairs and/or the person's daily life due to physical or mental limitations or old age.
A guardianship is a court-appointed position that gives a person, institution, or agency the legal authority to manage the affairs of a minor or incompetent adult who is incapable of managing their own personal or financial matters. Once established, a conservatorship or guardianship cannot be revoked without a court order. Only one primary customer and one conservator or guardian is allowed on an account. Such accounts cannot have beneficiaries, and the primary customer cannot make transactions or account changes without the signature or permission of the Conservator or Guardian.
Persons granted conservatorship or guardianship have the same permissions as a power of attorney.
Frequently Asked Questions
I have multiple accounts with Capital One (e.g. credit card, checking account, etc). Once I submit my documentation, will my conservator or guardian agent request be applied to each of my accounts?
When submitting your request online, you will have the option to request to have the Conservator/Guardian applied to each of your qualified account types. Please be sure to enter in each account number in the submission form for each account in which the Conservator/Guardian has been granted authority.
I've submitted all of the required documents. How will I be notified when the conservator or guardian agent has been added to the account?
Once we receive your documentation, it can take up to 7 business days to process the request. Once it is determined your request and documentation meet all applicable requirements, the Conservator/Guardian request will be added to the account. We will respond to your request via standard mail confirming your request was decisioned. To help us process your request as quickly as possible, please ensure all required documentation is included with your request.
How do I remove a conservator or guardian agent from my account?
You may request to remove a conservator/guardian by completing the required information within the online form & selecting "Remove authority".
