When you contact us about the death of a loved one, you may need to provide the following information about the account holder depending on what action you intend to take on the account, if any:
*Having the Date of Death and/or the Death Certificate is not required, but can be helpful in verifying the decedent’s information.
**The Fiduciary Rights Form will be provided to you by Capital One Auto Finance to complete. You’ll receive an email with a link to upload and eSign, or can choose to print and mail the documents to us, to become the named Person Handling the Affairs (PHA) for the auto loan.
How long does it take to become a Person Handling the Affairs (PHA)?
It can be the same day you call us. Timing depends on how quickly you provide all the required information and we can verify the borrower has passed.
How does Capital One verify a borrower is deceased?
We access public records. If we are unable to verify the passing of a borrower, we may request a death certificate from you.
Do I have to call when a borrower has passed away?
If you don’t wish to call us, you can send us a letter via mail or fax. However you prefer to reach out, we appreciate you letting us know so we may assist you in managing this auto loan.
What happens if there are two borrowers and only one has passed?
The living borrower can continue to manage the auto loan without interruption. We recommend you notify us of the death of either the borrower or co-borrower, so we can help you verify or update your contact or payment information.
